Terms of Use for Trelv

These Terms of Use explain the rules that apply when you access or use Trelv, a virtual pressed flower composition studio for arranging botanical materials, paper backdrops, ribbons, stamps, and other decorative elements into digital artworks. The app is designed for personal creativity, quiet experimentation, and saved botanical compositions.

For purposes of these Terms, "Trelv," "we," "us," or "our" refers to the operator of the Trelv application. "You" and "your" refer to the person using the app. These Terms apply to the mobile application, the creative tools, any built-in assets, any imported materials you add to the app, the personal gallery, optional PetalPoints, premium materials, and related support communications.

No account is required. Trelv does not require you to create a username, password, or profile in order to use the core app experience. You can open the app and begin creating without signing in.

1. Consent to the Workshop

Acceptance of These Terms

By downloading, opening, accessing, or using Trelv, you agree to these Terms. If you do not agree, do not use the app. You may stop using Trelv at any time by deleting it from your device, subject to any separate rules that apply to App Store purchases, subscriptions, refunds, or device backups.

If you use Trelv on behalf of another person or organization, you represent that you have authority to accept these Terms for that person or organization. If you are not legally old enough to enter into a binding agreement in your place of residence, you may use Trelv only with involvement and permission from a parent or legal guardian.

We may update these Terms from time to time. The updated document will be posted with a new effective date. Continued use of Trelv after the effective date of updated Terms means you accept the updated Terms. If a change is material, we may provide additional notice inside the app or through another reasonable method.

2. The Creative Studio

License to Use Trelv

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Trelv on devices you own or control, solely for lawful personal or internal creative purposes. This license does not transfer ownership of Trelv, its code, designs, built-in botanical assets, interface elements, text, icons, animations, premium catalog, or other app materials.

Trelv lets you create digital pressed-flower compositions by using built-in materials, imported images, paper backdrops, layers, transformations, and decorative elements. You may save, view, edit, export, and share your own artworks using the tools provided in the app. Some features or assets may be free, and others may require PetalPoints, a premium unlock, or an in-app purchase.

No Login Guarantee

Trelv is designed so that core use does not depend on account login. Because no account is required, certain account-based features may not be available, such as cloud synchronization through a Trelv account, public profile recovery, server-side project history, or cross-device identity management. Device-level backups or app-store purchase restoration may still depend on services provided by your platform provider.

App Store and Platform Terms

Your use of Trelv may also be subject to the rules of the app marketplace, operating system, device manufacturer, payment provider, or platform services you use. If there is a conflict between these Terms and mandatory platform rules, the mandatory platform rules may control only to the extent of the conflict.

3. Your Materials and Artwork

Your Content

"Your Content" means images, photos, imported materials, artwork titles, compositions, exported files, and other creative content that you import into Trelv, create within Trelv, save to your gallery, export, or share from your device. You retain your rights in Your Content, subject to the rights you grant us and the rights of others.

You are responsible for Your Content. You represent and warrant that you have the rights, permissions, and licenses needed to import, edit, save, export, and share Your Content through Trelv. You agree not to import or use content that infringes intellectual property rights, violates privacy or publicity rights, contains unlawful material, or otherwise violates applicable law.

Your Creative Ownership

As between you and Trelv, the original compositions you create with the app are yours. Trelv does not claim ownership over your personal botanical arrangements, saved gallery works, imported photos, or exported artworks. However, the app's built-in materials, interface, templates, textures, artwork assets, software, premium packs, and brand elements remain owned by us or our licensors.

Limited Technical License

To operate the app on your device, you grant us a limited license to process, display, arrange, transform, save, render, export, and share Your Content as needed to provide the features you request. Because Trelv is designed as a local, no-account creative app, this license is intended to be functional and limited. It does not give us permission to sell your personal artwork or use it in marketing without your separate consent.

Imported Photos and Personal Material

If you import a photo or image from your device, you remain responsible for that image. Trelv may copy the imported file into the app's local storage so it can be used as a reusable material in your compositions. Deleting the original photo from your device library may not automatically delete the copy stored inside Trelv, and deleting Trelv may remove locally stored app data depending on your device and backup settings.

Exporting and Sharing

When you export or share an artwork, you choose where it goes. Shared files may be handled by operating-system share sheets, messaging apps, cloud services, social networks, or other third parties outside our control. You are responsible for reviewing the destination before sharing.

4. Care Instructions

Acceptable Use

You agree to use Trelv only for lawful purposes and in a manner consistent with these Terms. You may not:

  • reverse engineer, decompile, disassemble, modify, or create derivative works from Trelv except where applicable law permits;
  • copy, scrape, extract, sell, redistribute, or commercially exploit built-in assets, premium materials, icons, designs, animations, or source materials outside the app except as part of your own exported compositions where permitted by the app experience;
  • use Trelv to create, import, save, or share content that is unlawful, harassing, exploitative, abusive, defamatory, invasive of privacy, or infringing;
  • attempt to bypass payment flows, unlock restrictions, entitlement checks, app-store controls, or technical protections;
  • interfere with the operation, security, integrity, or availability of Trelv;
  • use automated tools to access, test, or manipulate the app in a way that exceeds ordinary personal use;
  • misrepresent your ownership of content, rights in third-party images, or relationship with Trelv;
  • use Trelv in a way that violates export control laws, sanctions rules, consumer protection laws, intellectual property laws, or privacy laws.

We may limit, suspend, or disable access to features if we reasonably believe your use violates these Terms, creates legal risk, or harms Trelv, users, platforms, payment systems, or third parties.

5. PetalPoints and Premium Packs

In-App Purchases, Virtual Items, and Unlocks

Trelv may offer optional in-app purchases, including PetalPoints, premium botanical materials, ribbons, decorative elements, paper backdrops, high-resolution export features, or other unlockable content. Purchases are not required to use the basic app unless a specific feature is clearly marked as premium.

Payment Processing

In-app purchases are processed by the applicable app marketplace or payment platform, not directly by Trelv. Your payment information, refund eligibility, family sharing availability, purchase restoration, taxes, and transaction records may be governed by the payment platform's terms and policies. We do not control all platform refund decisions.

PetalPoints

PetalPoints, if offered, are a virtual in-app value used only inside Trelv to unlock eligible digital materials or features. PetalPoints are not money, stored value, cryptocurrency, gift cards, bank credit, or real-world currency. They have no cash value, are not redeemable for cash, and may not be sold, transferred, traded, assigned, or exchanged outside the app except where required by law.

Premium Unlocks

Premium unlocks are licensed digital features, not physical goods. Availability may depend on your device, app release, platform services, region, purchase validation, and local data. If you delete the app, reset your device, disable backups, change app-store accounts, or lose local data, some locally stored entitlements may need to be restored through available platform restoration tools. We cannot guarantee restoration where platform records are unavailable or where a purchase was not completed.

Pricing and Availability

Prices, descriptions, promotional offers, eligibility, and availability may change. We may add, modify, rebalance, discontinue, or replace premium materials or virtual items, provided that we do not intentionally deprive you of paid content without a reasonable substitute or legally required remedy. Taxes and currency exchange rates may vary by region.

6. Quiet Data Practices

Privacy and Permissions

Your use of Trelv is also governed by our Privacy Policy. The Privacy Policy explains how Trelv handles local app data, imported images, gallery access, purchase-related data, device permissions, tracking choices, support emails, and privacy rights.

Trelv may ask for device permissions only when needed for relevant features, such as importing images from your photo library, saving artwork to your album, using the system share sheet, or requesting tracking authorization where applicable. You can manage permissions through your device settings. Some features may not work without the permission they require.

7. Age and Families

Children and Family Use

Trelv is a general-audience creative tool and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you are under 13, do not provide personal information to us. If a parent or guardian believes that a child has provided personal information to us, contact us so we can review and delete it where required by law.

If a child uses Trelv on a family device, the parent or guardian is responsible for supervising use, managing device permissions, controlling purchase restrictions, reviewing shared artwork destinations, and making sure imported images are appropriate and lawful.

8. The Herbarium Cabinet

Intellectual Property

Trelv and its app design, software, source code, object code, interface, workflow, brand name, logos, icons, built-in artwork, sample botanicals, backdrops, textures, premium packs, animations, copy, and other materials are protected by intellectual property and other laws. Except for the limited license granted in these Terms, no rights are transferred to you.

You may not use the Trelv name, logo, trade dress, or confusingly similar marks in a way that suggests endorsement, sponsorship, affiliation, or ownership without our written permission. You may identify that an artwork was created using Trelv if that statement is truthful and not misleading.

Feedback

If you send us suggestions, ideas, bug reports, design notes, feature requests, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without restriction or compensation to you. This does not give us ownership of your personal artwork or imported materials.

9. Outside the Frame

Third-Party Services

Trelv may interact with third-party services and platform features, such as app marketplaces, in-app purchase systems, operating-system share sheets, photo libraries, web views, analytics or crash diagnostics if enabled, cloud backups, and support email providers. Third-party services are governed by their own terms and policies. We are not responsible for third-party services, content, outages, decisions, or data practices.

If Trelv displays links to legal documents, platform pages, support pages, or other external resources, those links are provided for convenience. We do not control external websites and cannot guarantee that their content will remain available, accurate, secure, or suitable for your needs.

10. Seasonal Changes

Changes, Updates, and Availability

We may update Trelv to improve performance, fix bugs, change features, add materials, modify premium offerings, adjust compatibility, or comply with legal requirements. Updates may be required for continued use. Some features may not be available on all devices, operating systems, app releases, regions, or platform accounts.

We do not promise that Trelv will be uninterrupted, error-free, permanently available, compatible with every device, or capable of preserving every file under every circumstance. You are responsible for maintaining your device, backups, exported files, and any copies of creative work that matter to you.

11. As-Is Materials

Disclaimers

To the maximum extent permitted by law, Trelv is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, compatibility, and uninterrupted operation.

Trelv is a creative tool, not a professional design, legal, medical, archival, printing, rights-clearance, or commercial publishing service. You are responsible for reviewing your artworks, exports, image rights, and intended use before sharing, printing, selling, submitting, or relying on them.

12. Pressed Flat, Not Unlimited

Limitation of Liability

To the maximum extent permitted by law, Trelv and its owners, operators, developers, licensors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; loss of goodwill; device issues; purchase disputes controlled by a platform; third-party conduct; or inability to use the app.

To the maximum extent permitted by law, our total liability for all claims related to Trelv or these Terms will not exceed the greater of the amount you paid to Trelv for the app or relevant in-app purchase in the three months before the event giving rise to the claim, or ten U.S. dollars. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

13. Your Pressing Board

Indemnification

You agree to defend, indemnify, and hold harmless Trelv and its owners, operators, developers, licensors, service providers, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to: Your Content; your use or misuse of Trelv; your violation of these Terms; your violation of law; your infringement or misappropriation of third-party rights; or your dispute with another person or third-party service.

14. Closing the Album

Termination

You may stop using Trelv at any time. We may suspend, terminate, or restrict your access to Trelv or any feature if you violate these Terms, create legal risk, attempt to bypass technical restrictions, misuse purchases, or harm the app, users, platforms, or third parties.

Upon termination, your license to use Trelv ends. Provisions that by their nature should survive termination will survive, including intellectual property, purchase limitations, disclaimers, limitation of liability, indemnification, dispute terms, and general legal provisions.

15. Governing Law

U.S. Legal Terms and Disputes

These Terms are intended to be interpreted consistently with applicable laws of the United States. To the extent permitted by law, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. If you are a consumer, you may also have mandatory rights under the laws of your state or country that cannot be waived by contract.

Before filing a formal claim, you agree to contact us at the email address below and give us a reasonable opportunity to resolve the issue informally. Your notice should include your device type, app marketplace, purchase identifier if relevant, a description of the issue, and the remedy you request. We will try to respond within a reasonable time.

Any dispute that is not resolved informally will be handled in a court of competent jurisdiction unless applicable law or platform rules require another process. You and Trelv waive any right to bring or participate in a class action to the maximum extent permitted by law. Nothing in these Terms prevents either party from seeking injunctive or equitable relief for misuse of intellectual property, unauthorized access, or other urgent harm.

16. Fine Fibers

General Provisions

These Terms, together with the Privacy Policy and any additional terms shown for specific features or purchases, form the entire agreement between you and Trelv regarding the app. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or operation of law.

Headings are for convenience only. The word "including" means "including without limitation." Electronic records, app screens, and online documents may be used to satisfy legal writing and notice requirements where permitted by law.
